These Terms of Service (“Terms”) govern access to and use of MaxpipeCallBoost.com, 888-88-LEAKY, Maxpipe Call Boost, and related territory, routing, and call-management services (collectively, the “Services”) provided by Total Property Associates LLC, doing business as Maxpipe ROI and Maxpipe Call Boost (“Maxpipe,” “we,” “us,” or “our”).
1. Acceptance and Other Agreements
By accessing the website, submitting an inquiry, or using the Services, you agree to these Terms. If you use the Services for a company, you represent that you have authority to bind that company.
A signed territory license, order form, subscription agreement, or other written customer agreement may contain additional or different terms. If a signed agreement conflicts with these Terms, the signed agreement controls for that customer relationship.
2. Business Purpose and Eligibility
The Services are designed for roofing companies and their authorized personnel. You must be at least 18 and legally capable of entering a binding agreement. The website is not intended to provide roofing, emergency, legal, or consumer-protection advice.
3. Territory Availability and Licensing
Submitting a territory inquiry does not reserve a territory or grant rights to 888-88-LEAKY. Territory availability, boundaries, term, fees, permitted advertising, exclusivity, and activation are established only in an executed written agreement with Maxpipe.
When a territory is activated on an exclusive basis, the licensed roofing company receives the advertising-use rights described in its agreement for that assigned territory. Availability may change until the applicable agreement is signed and activation requirements are completed.
4. Use of 888-88-LEAKY
Authorized customers may use 888-88-LEAKY only in accordance with their written agreement, approved territory, brand guidelines, and applicable advertising laws. A license does not transfer ownership of the number, Maxpipe technology, trademarks, creative materials, or other intellectual property.
You may not use the number outside your authorized territory, misrepresent your relationship with Maxpipe, make deceptive or unsubstantiated claims, interfere with another territory, or use the Services for unlawful, abusive, fraudulent, or harmful activity.
5. Call Routing and Geographic Signals
Maxpipe Call Boost is designed to connect inbound callers with the roofing provider assigned to the relevant licensed territory. Routing may use available geographic indicators such as the caller’s area code, telephone-number information, configured area-code or ZIP-code rules, and territory settings.
Because telephone numbers can be ported, retained after a move, shared, or otherwise differ from a caller’s current physical location, geography-based routing may occasionally connect a call to a provider other than the provider associated with the caller’s intended service address. This is a normal limitation of area-code-based routing, and it does not affect the underlying territory license. Providers and callers should confirm the service location during the conversation, and Maxpipe may review or adjust routing rules when appropriate.
6. Not a Shared-Lead Marketplace
Maxpipe does not operate the Services as a marketplace that sells the same homeowner inquiry to multiple roofing companies. Customers license an advertising response asset for an assigned territory and generate inquiries through their own advertising. We do not guarantee any number of calls, leads, appointments, sales, revenue, or return on advertising spend.
7. Territory Inquiries and Communications
When you submit the territory form, you request that Maxpipe contact you using the name, email address, and telephone number provided to discuss availability and the Services. You may ask us to stop promotional communications at any time. Consent to receive marketing communications is not a condition of purchasing Services where prohibited by law.
8. Customer Responsibilities
Customers are responsible for their roofing services, licenses, permits, insurance, advertising content, customer relationships, employees, contractors, and compliance with applicable law. Customers must keep account and routing information accurate, protect account credentials, promptly report suspected misuse, and cooperate in resolving routing or service issues.
9. Call Records and Recordings
The Services may provide call records, caller information, and recordings when enabled. Customers may access and use these features only for legitimate business purposes and must provide all notices and obtain all consents required by applicable federal and state laws. Customers are responsible for training personnel and configuring their practices accordingly.
10. Fees, Billing, and Suspension
Fees, payment terms, renewals, territory charges, usage, wallet funding, and cancellation terms are governed by the applicable written agreement and billing selections. We may suspend or limit Services for nonpayment, security concerns, unlawful use, material breach, or conduct that threatens the Services or other users, subject to any controlling written agreement.
11. Intellectual Property
The Services, software, website, designs, trademarks, content, routing systems, and related materials are owned by Maxpipe or its licensors and are protected by law. Except for limited rights expressly granted in writing, no rights are transferred to you. Feedback may be used by Maxpipe without restriction or compensation.
12. Third-Party Services
The Services may rely on or link to third-party hosting, telecommunications, scheduling, payment, mapping, intake, and other providers. Third-party services are governed by their own terms and may change or become unavailable. Maxpipe is not responsible for third-party products or acts outside its reasonable control.
13. Service Changes and Availability
We may maintain, improve, modify, or discontinue features and may take reasonable steps to protect security and reliability. Telecommunications networks, internet services, power, carriers, and third-party systems can experience interruptions or delays. We do not promise uninterrupted or error-free operation.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Maxpipe disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant territory profitability, advertising performance, call volume, routing perfection, lead quality, or business results. Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
15. Limitation of Liability
To the maximum extent permitted by law, Maxpipe and its owners, affiliates, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Services.
Unless a signed agreement states otherwise, Maxpipe’s aggregate liability arising from the Services will not exceed the greater of $100 or the amount paid to Maxpipe for the affected Services during the six months preceding the event giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Maxpipe and its affiliates, owners, personnel, and providers from third-party claims, liabilities, damages, and reasonable costs arising from your roofing services, advertising, unlawful or unauthorized use of the Services, violation of these Terms, or infringement of another person’s rights.
17. Governing Law and Venue
These Terms are governed by Florida law, without regard to conflict-of-law principles. Unless a signed agreement states otherwise, the state and federal courts located in Palm Beach County, Florida, will have exclusive jurisdiction over disputes arising from these Terms or the Services, and each party consents to that jurisdiction and venue.
18. General Terms
If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business transaction or by operation of law. Headings are for convenience only.
19. Changes to These Terms
We may update these Terms from time to time. The effective date above identifies the current version. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
